These Terms and Conditions govern use of the kinburien website and the services provided at our senior residential care facility in Chiang Mai, Thailand. By accessing this website or entering into a residency agreement with kinburien, you agree to the terms set out below.

By using this website or entering into a residency arrangement with kinburien, you confirm that you are aged 18 or over, have the legal capacity to enter this Agreement, and accept these Terms in full. If you are acting on behalf of a resident, you represent that you are authorised to do so.

3. Service Description

kinburien provides three tiers of senior residential care — Garden Residence, Wellness Residence, and Full Embrace Residence. Each tier includes the services described on our website and in the residency agreement. Services are subject to availability. kinburien reserves the right to adjust specific service components with reasonable notice to the resident and their family.

kinburien is a residential care facility and not a licensed hospital or medical clinic. Medical treatment is coordinated with external healthcare providers where required.

4. Residency Agreement

Admission to kinburien is formalised through a written residency agreement, which sets out the applicable care tier, monthly fee, notice period, and other specific terms. These Terms and Conditions form part of that agreement. In the event of any conflict, the signed residency agreement takes precedence.

All prospective residents undergo an initial care needs assessment prior to admission. kinburien reserves the right to decline admission or recommend a different care setting if the assessed needs fall outside the scope of services offered. This decision is made respectfully and with the wellbeing of the individual as the primary consideration.

7. Care Plans and Changes

Each resident has an individual care plan, reviewed at least quarterly and whenever significant changes occur. Family representatives are included in reviews. kinburien may recommend transitioning a resident to a different care tier if their needs change materially. Such transitions are discussed with the family and carried out with the resident's comfort as the priority.

8. Visiting Policy

kinburien maintains an open visiting policy throughout the week. Visitors are asked to respect the facility's calm environment and the wellbeing of other residents. kinburien reserves the right to set reasonable visiting conditions and to restrict access in cases where a visit is assessed as harmful to a resident's wellbeing.

All content on the kinburien website — including text, images, design, and branding — is owned by or licensed to kinburien. You may not reproduce, distribute, or use any content without prior written consent.

11. Disclaimers

kinburien provides care services with genuine commitment to the wellbeing of each resident. However, we cannot make specific commitments regarding health outcomes, as these depend on many factors beyond the control of any care facility. Information on this website is provided for general purposes and does not constitute medical advice.

12. Limitation of Liability

To the maximum extent permitted under Thai law, kinburien's liability in connection with the services provided is limited to the monthly fee paid by the resident for the period in which the issue arose. kinburien is not liable for indirect, consequential, or incidental losses. Nothing in these terms limits liability for death or personal injury caused by negligence.

13. Termination

By the Family or Resident

A minimum notice period of 30 days applies for voluntary departure, as specified in the residency agreement. Fees for any partial month are calculated on a pro-rata basis.

kinburien may terminate a residency arrangement with appropriate notice if fees remain unpaid, if a resident's needs exceed the scope of services available, or in cases of conduct that endangers the safety or wellbeing of others. We will always seek to handle such situations with sensitivity and appropriate care planning.

14. Dispute Resolution

We encourage any concerns to be raised with our team directly in the first instance. If a formal dispute arises, the parties agree to attempt resolution through good-faith discussion before seeking formal legal proceedings. These Terms are governed by the laws of the Kingdom of Thailand. Any dispute not resolved informally shall be subject to the jurisdiction of the courts of Chiang Mai.

15. Changes to These Terms

kinburien may update these Terms from time to time. The current version is always available on this page. Residents and families will be notified of material changes. Continued use of our services following notification constitutes acceptance of the revised terms.
